The national standard diesel fuel has also gradually spread from the first-tier cities.
However, for the country to really land, there are still many people who have a negative attitude. Why is this so? This is actually a historical source. In the past decade or so, although the emission standards for heavy-duty diesel vehicles have been upgraded repeatedly, the actual implementation is rare. In 2003, China began to implement the national emission standards. Many heavy-duty truck companies did not pay attention to it, and fraudulent behaviors occurred from time to time. The same was true for the national three standards that began in 2008. Some enterprises also created “fake countries without electronically controlled injection. Article 33 of the Law on the Prevention and Control of Atmospheric Pollution clearly stipulates that if the motor vehicle in use does not meet the emission standards for the pollutants in use at the time of manufacture, it shall not be allowed to drive on the road. This means that if the vehicle is used to meet the current emission standards, it can be driven on the road. This includes many in-use vehicles that are still in the national three-emission level. Can it be recalled in the name of environmental protection?
For those diesel vehicles that do not meet the national standards in terms of emissions, can they use the "Defective Automobile Product Recall Management Regulations" to recall them as mentioned in the Chai Jing film?
Judging from the provisions of the law, this assumption does not work. According to the Regulations on the Management of Defective Automobile Product Recalls, which was officially implemented on January 1, 2013, the so-called “defects” refer to the prevalence of a certain batch, model or category of automotive products due to design, manufacture, identification, etc. Unreasonable dangers that endanger the safety of people and property. Diesel vehicles that do not meet the national standard in emissions obviously do not meet the definition of this "defect".
We tried to find a basis from the Law on Prevention and Control of Atmospheric Pollution. Article 53 of the Law stipulates that if a motor vehicle or ship that exceeds the discharge standard of pollutants is manufactured, sold or imported, the department that exercises supervision and management according to law shall order it to stop the illegal act and confiscate the illegal act. The income can be punishable by a fine of less than twice the illegal income; for motor vehicles and vessels that fail to meet the prescribed pollutant discharge standards, they are confiscated and destroyed. However, there are two unclear rules: First, there is no indication that the "motor vehicle" is a new car or a car, and the second is that the "department that exercises supervision and management rights" is unclear. The handling of confiscation and destruction cannot be discussed. .
In this regard, Li Kunsheng, director of the Motor Vehicle Emissions Management Office of the Beijing Municipal Environmental Protection Bureau, pointed out that if the emission of vehicles in use is not up to standard, the environmental protection department should be responsible for the “environmental recall” and increase the durability mileage in the “Atmospheric Law”. Whose responsibility? Whose law enforcement power?
In May last year, after CCTV exposed some of the domestic diesel vehicle companies’ fraudulent behavior, the China Automobile Association organized a special meeting for the leaders of eight major production enterprises. The participating companies finally formed a corporate self-discipline commitment. Committed to producing products that meet the requirements of national regulations, and do not adopt atypical technical routes that cannot continue to meet strict standards and easily cause market disruption to affect market supervision, and do not use decks to sell.
However, only corporate self-discipline is not enough. As a social unit for profit, the pursuit of profit is the nature of the company. How to put the profit-making circle within a reasonable and legal range, it also depends on the supervision and inspection by the government departments, and even if the motor vehicle emissions meet the standards.
Who is responsible for the discharge of motor vehicles? From the notice issued in September last year, the "New Production Vehicle Environmental Protection Supervision Work Plan", it is known that it involves five departments including the Ministry of Environmental Protection, the Ministry of Industry and Information Technology, the Ministry of Public Security, the State Administration of Industry and Commerce, and the General Administration of Quality Supervision, Inspection and Quarantine. Among them, the Ministry of Environmental Protection always takes the lead in supervising and inspecting the new environmental protection standards for motor vehicles and engines, explaining the vehicle emission standards, and actively cooperating with the other four ministries and commissions, establishing corresponding working mechanisms, implementing the division of responsibilities, and organizing implementation.
However, people often say that "five dragons are not treated by water", and the joint enforcement of many ministries and commissions is not the norm, and can only be used as an "active" law enforcement. The establishment of a long-term mechanism ultimately depends on a clear law enforcement department and a clear law and regulation.
The "New Production Motor Vehicle Environmental Protection Standards Supervision Work Plan" states that the General Administration of Quality Supervision, Inspection and Quarantine and the Ministry of Environmental Protection shall promptly study and introduce the environmental protection recall management regulations for motor vehicles, and determine that the vehicle emission performance is not up to standard due to design and production defects. The production enterprises are required to bear the main responsibility, perform the recall obligation according to law, and carry out environmental recalls for the over-standard vehicles to eliminate hidden dangers.
