The U.S. Supreme Court overturned a judgment of the Court of Appeal that listed the three overseas subsidiaries of Goodyear Tire & Rubber as defendants. The judgment involved the plaintiffs who were the family members of the two youngsters in North Carolina. The two teenagers died in a traffic accident in France.
This is one of the rulings made by the Supreme Court on Monday that foreign companies and overseas subsidiaries of American companies were prevented from being prosecuted in US courts. The North Carolina State Court of Appeal stated that even if the accident occurred abroad, the Goodyear branch still had enough contact with the state, so the court had jurisdiction. The Supreme Court stated in past cases that according to the U.S. Constitution, defendants are only charged in states where there is an important connection with them.
Julian Brown and Matt Helms, who were 13 years old, died in a car accident in France in 2004 when the car they were riding reportedly had a tire burst, which caused the car to collide with a concrete wall. They were participating in a youth football tour in France. Goodyear defended that the tires manufactured by the three subsidiaries were mainly sold to the European and Asian markets and did not sell in North Carolina. In another judgment on Monday, the Supreme Court ruled that a British manufacturer was unfit to be sued.
